These Terms & Conditions govern your access to and use of Rosemary Career Academy's website, applications, educational programs, counselling services, courses, digital resources, assessments and related services.
By accessing our website, creating an account, submitting an enquiry, registering for a course, attending a class, purchasing a Service, using digital learning resources or otherwise using the Platform, you agree to these Terms & Conditions.
If you do not agree with these Terms, please do not use the Platform or Services.
Rosemary Career Academy is an educational and career-development institution providing academic tuition, competitive examination preparation, career counselling, skill development, language programs, assessments, study resources and related educational services.
Services may be offered through physical classrooms, online platforms, mobile applications, websites, hybrid programs, counselling sessions and other approved delivery methods.
1. Definitions
In these Terms & Conditions:
- “Rosemary”, “we”, “us” or “our” means Rosemary Career Academy and its authorised representatives.
- “Platform” means the Rosemary website, applications, portals, digital platforms and related technology used to provide our Services.
- “Services” means educational courses, tuition, counselling, assessments, study resources, notifications and other services offered by Rosemary.

- “Parent/Guardian” means a parent or lawful guardian acting on behalf of a student where applicable.
- “Course” means any academic, competitive examination, skill, language, counselling or other educational program offered by Rosemary.
2. Eligibility
You must provide accurate information and have the legal capacity required to enter into an agreement for the relevant Service.
Students who are minors may use applicable Services subject to involvement, consent or supervision of a parent or lawful guardian where required by applicable law.
Rosemary may refuse, suspend or restrict access where information provided is materially inaccurate, fraudulent or misleading.
3. Registration & Accounts
Certain Services may require you to create an account or submit registration information.
You agree to:

- Keep your information reasonably updated.
- Maintain the confidentiality of login credentials.

4. Student Responsibilities
Students are expected to maintain appropriate conduct and actively participate in their educational programs.
- Attend scheduled classes and sessions.
- Complete assignments and assessments honestly.
- Follow teacher and staff instructions.
- Respect teachers, staff and other students.
- Protect institutional property and digital resources.
- Do not engage in harassment, bullying or abusive behaviour.
- Do not share paid study materials without permission.
- Do not attempt to disrupt Platform systems.
5. Parent / Guardian Responsibilities
Where a student is a minor, parents or lawful guardians may be responsible for ensuring that the information provided to Rosemary is accurate and for supporting the student's compliance with applicable course rules.
Parents/guardians should review relevant course, fee, attendance, refund and communication policies before enrolling a student.
6. Courses & Educational Services
Rosemary may offer academic tuition, school education support, competitive examination preparation, career counselling, skill-development programs, language programs, mock tests, assessments and other educational services.

7. Admission & Enrolment
Admission or enrolment is subject to availability, eligibility, applicable admission requirements and successful completion of the registration process.
Submission of an enquiry or application does not automatically guarantee admission unless expressly confirmed by Rosemary.
Rosemary may request documents or information reasonably required for admission, eligibility verification, scholarship processing or administration.
8. Fees & Payments
Course fees, instalments, discounts, offers and payment schedules will be communicated through the applicable admission or course documentation.
Students/parents are responsible for paying applicable fees within the specified time. Failure to make required payments may result in suspension or cancellation of access to the relevant Service, subject to the applicable fee policy.
Payment processing may be performed through third-party payment providers. Their terms may also apply to the transaction.
Any applicable taxes, transaction charges or other statutory charges will be handled according to applicable requirements.
9. Refund & Cancellation
Refunds, cancellations, transfers and fee adjustments shall be governed by Rosemary's applicable Refund/Cancellation Policy communicated for the relevant Course or Service.
Different programs may have different refund rules depending on course duration, commencement date, delivery method, materials provided and services already consumed.
Enrolment in a course does not automatically create an unconditional right to a refund. Refund eligibility will depend on the applicable course-specific refund policy and applicable law.
10. Attendance & Participation
Students are expected to attend classes, counselling sessions, tests and other scheduled activities applicable to their Course.
Rosemary may establish attendance requirements for individual programs.
Absence from a class does not necessarily create an automatic entitlement to a refund, replacement class or extension unless expressly provided by the relevant Course policy.
11. Academic Performance & Results
Rosemary provides educational instruction, preparation, resources and guidance. However, examination results and academic outcomes depend on numerous factors, including student effort, attendance, preparation, examination difficulty, competition and external circumstances.
Rosemary does not guarantee that a student will obtain a particular rank, score, admission, job, scholarship or examination result.
Any historical result, achievement, testimonial or performance example should not be interpreted as a guarantee of future performance.
12. Study Materials & Digital Content
Course participants may receive books, notes, PDFs, videos, presentations, tests, question banks, digital resources or other educational materials.
Such materials are provided for the personal educational use of the enrolled student unless otherwise stated.
Without prior written permission, users must not:
- Resell Rosemary study materials.
- Upload paid materials to public websites.
- Share paid content through messaging groups or file-sharing platforms.
- Copy or reproduce substantial portions for commercial purposes.
- Remove copyright or ownership notices.
- Use Rosemary content to create a competing commercial service.
13. Tests, Mock Tests & Assessments
Rosemary may conduct mock tests, quizzes, assessments and performance reviews as part of its Services.
Students must complete assessments honestly and independently unless collaboration is expressly permitted.
Rosemary may invalidate an assessment where there is reasonable evidence of cheating, impersonation, unauthorised assistance, manipulation or other examination misconduct.
14. Online Learning & Digital Platform
Online classes and digital services depend on internet connectivity, compatible devices, software and third-party infrastructure.
Rosemary is not responsible for interruptions caused by a user's internet connection, device failure, power outage, third-party platform failure or circumstances outside Rosemary's reasonable control.
Rosemary may change the technical platform, application, communication method or delivery technology where reasonably necessary.
15. Acceptable Use
You agree to use the Platform lawfully and responsibly.
You must not:
- Use the Platform for unlawful purposes.
- Attempt to gain unauthorised access to accounts or systems.
- Upload malware, viruses or malicious code.
- Interfere with Platform security or functionality.
- Impersonate another person.
- Submit fraudulent or misleading information.
- Harass, threaten or abuse students, teachers or staff.
- Use automated systems to scrape substantial Platform content without permission.
- Record or distribute classes without appropriate permission.
- Share another student's personal information without authorisation.
16. Intellectual Property
Unless otherwise stated, Rosemary and/or its licensors retain rights in the Platform and its original content, including:
- Logos and branding
- Course materials
- Study notes
- Videos and educational content
- Graphics and illustrations
- Website design
- Software and functionality
- Original question banks and assessments
- Text, articles and educational resources
Access to educational content does not transfer ownership or intellectual-property rights to the user.
17. Photography, Video & Recording
Rosemary may conduct educational events, seminars, workshops, activities or promotional events where photography or video recording may take place.
Where student images, testimonials or identifiable content are intended for public promotional use, Rosemary will seek appropriate permission or consent where required by applicable law.
Students and visitors must not record classes, teachers or other students for publication or commercial distribution without appropriate permission.
18. Communications
Rosemary may communicate with students, parents or users through email, telephone, SMS, messaging services, application notifications or other communication channels.
Communications may include:
- Admission information
- Class schedules
- Academic updates
- Test information
- Payment reminders
- Course announcements

- Job notifications
- Promotional communications where permitted
Users may opt out of non-essential promotional communications where an appropriate opt-out mechanism is provided.

Third-party services are independently operated and may have their own terms and privacy policies.
Rosemary does not control third-party websites or guarantee their availability, accuracy, security or content.
20. Job & Career Notifications
Rosemary may provide information regarding employment opportunities, examinations, vacancies, government notifications, recruitment notices, scholarships and career-related opportunities.
Such information may originate from external organisations or publicly available sources.
Rosemary does not guarantee employment, selection, interview calls, examination qualification, appointment, salary or recruitment outcome merely because a notification or opportunity is communicated through our Platform.
Users should independently verify eligibility, deadlines, application procedures and official notifications before applying.
21. Privacy
Our collection and use of personal information is governed by our Privacy Policy.
By using the Platform, you acknowledge that you have had the opportunity to review our Privacy Policy.

22. Suspension & Termination
Rosemary may suspend or terminate access to a Platform or Service where reasonably necessary, including in circumstances involving:

- Non-payment of applicable fees.
- Academic misconduct.
- Harassment or serious misconduct.
- Unauthorised distribution of paid content.

- Legal or regulatory requirements.
Where termination occurs because of a serious violation of these Terms, refund eligibility may be affected by the applicable course and refund policies and applicable law.
23. Educational Disclaimer
Rosemary provides educational instruction, resources and guidance. Educational information is provided for learning and preparation purposes and should not be treated as a guarantee of a specific academic, employment or competitive-examination outcome.
Examination authorities, universities, government departments and other external organisations independently determine eligibility, examination rules, syllabi, results, admissions, recruitment and other outcomes.
24. Limitation of Liability
To the maximum extent permitted by applicable law, Rosemary will not be responsible for indirect, incidental, special or consequential losses arising from use of the Platform or Services.
This limitation does not exclude or restrict liability that cannot lawfully be excluded or restricted under applicable law.
Nothing in these Terms is intended to remove any mandatory consumer protection or statutory rights available to users.
25. Indemnification
To the extent permitted by applicable law, users agree to indemnify and hold Rosemary, its authorised representatives and service providers harmless from claims, losses or expenses arising from the user's unlawful conduct, material violation of these Terms, misuse of the Platform or infringement of third-party rights.
26. Force Majeure

Subject to applicable law, disputes shall be subject to the jurisdiction of the competent courts having jurisdiction over Rosemary Career Academy's principal place of business.
29. Severability

These Terms, together with the applicable Privacy Policy, Refund/Cancellation Policy, course-specific policies, admission documents and other policies expressly incorporated into the relevant Service, constitute the terms governing your use of that Service.
Where a specific course or service has additional written terms, those terms may apply to that particular Service.
